The contact owns a 2011 BMW X3. The contact stated while driving approximately 30 MPH, the vehicle stalled without warning. The contact pulled over but was unable to restart the vehicle. The contact stated no warning light was illuminated. The vehicle was not taken to be diagnosed or repaired and was towed to the residence. Upon investigation, the contact associated the failure with NHTSA Campaign Number: 14V176000 (Engine and Engine Cooling) however, the VIN was not included. The manufacturer was informed of failure and confirmed that the VIN was not included in the recall. The failure mileage was approximately 146,590.

Summary

Background •Per a letter sent out to the NHTSA on April 9, 2014 a recall was issued for several vehicles as the housing bolts for the vanos cams were deemed to be faulty and could loosen or shear off causing a stall. oNHTSA Campaign 14V176000 and all defect notices, recall acknowledgements, etc which are currently extant on the NHTSA website. ?Technical Service Bulletin SI B11 07 14 dated 10/14 oIncluded in this recall are X3 28i with engine type N52 manufactured between 1/2010 – 9/2011. oA 10-year extended warranty was issued for vehicles not specifically covered under the recall. oMy vehicle was manufactured and put into service 1/2011. oNo one to date has given a clear answer on why my VIN wasn’t listed as part of the recall. Incident •My wife and daughter were driving on the highway when the car stalled putting them in danger. They were able to pull off to the side without incident but were unable to start it again. •I had the car towed to BMW Fairfield where the team under Nate Sanchez diagnosed the issue. The was no check engine light, no drop in performance nor any indication at all that something was wrong before this happened. In fact, I had the car at Dave Parker’s Eurasian Autoworks for an AC diagnostic. They thoroughly checked the vehicle and could find no faults. oThe cause of failure was the bolts shearing off the Vanos cam, exactly as stated in the recall. oThe engine was inspected with an Otoscope and no additional engine damage was apparent. oTotal cost of the repair is estimated at $6100 Involving BMW NA Customer Service •Customer service was engaged to attempt to find a goodwill solution to the manufacturers defect. oCustomer service communication was spotty at best. When first I called, they told me that the car was covered under the extended warranty for the entirety of 2021. Upon the dealership calling, they were told that the warranty had expired. WHILE DRIVING ON A MOTORWAY AT MODERATE SPEEDS OF ABOUT 45 MPH, VEHICLE STARTED THROWING DYNAMIC STABILITY CONTROL, ENGINE CHECK LIGHT AND TRACTION CONTROL DEACTIVATION WARNINGS AND STARTED CUTTING OUT POWER TO THE WHEELS ALTHOUGH THE ENGINE CONTINUED TO IDLE SMOOTHLY. STRANDED ON THE MOTORWAY FOR A WHILE AND THEN AFTER SWITCHING OFF AND SWITCHING ON THE IGNITION COUPLE OF TIMES, VEHICLE STARTED TO DRIVE FORWARD IN LIMP MODE. HAD TO PULL OVER FOR SAFETY AND TOWED THE VEHICLE TO A LOCAL MECHANIC SHOP. THEY SAID THE ACCELERATOR PEDAL FAILED AND STOPPED SENDING ANY SIGNALS TO ENGINE CONTROL UNIT. THEY REPLACED THE GAS PEDAL AND EVERYTHING SEEMS TO BE BACK TO NORMAL.

THIS IS RELATED TO A 2011 BMW X3. THE SUNROOF JUST EXPLODED OUT OF NO WHERE. IT WAS A NICE SUNNY DAY AND WE WERE DRIVING ON THE HIGHWAY. WE WERE DRIVING AT NORMAL SPEED OF APPROXIMATELY 60-65MPH SINCE WE HAD 2 YOUNG CHILDREN IN THE CAR, A 1 YEAR OLD AND A 3 YEAR OLD. ALL OF A SUDDEN WE HEARD A LOUD BANG LIKE A GUNSHOT SOUND. WE THOUGHT THE TIRES BLEW OUT, SO WE PULLED OVER. MY HUSBAND STEPPED OUT OF THE CAR AND LOOKED AT ALL THE TIRES AND THEY WERE FINE AND INTACT. MY HUSBAND LOOKED ON TOP OF THE CAR AND SAW THE SUNROOF WAS SHATTERED. WE WERE SHOCKED. GOOD THING IS THAT WE DIDN'T HAVE THE SUNROOF OPENED AND THE GLASS DIDN'T FALL INSIDE THE CAR. NO ONE WAS HURT. ONCE THE INITIAL RESISTANCE IS OVERCOME, THE RESISTANCE LESSENS, RESULTING IN A TENDENCY TO TURN THE WHEEL FURTHER THAN WAS INTENDED. THIS MAKES IT DIFFICULT TO KEEP THE CAR CENTERED IN MY LANE AND RESULTS IN THE CAR JERKING FROM SIDE TO SIDE WHICH MAKES IT DANGEROUS AND STRESSFUL. I CAME OUTSIDE ONE MORNING TO FIND THAT ALL MY WINDOWS WERE ROLLED DOWN, THE SUNROOF WAS ROLLED COMPLETELY BACK, AND THE DOORS WERE UNLOCKED. IT HAD BEEN RAINING HEAVILY THE NIGHT BEFORE AND THE INTERIOR OF THE CAR WAS COMPLETELY SOAKED. THE IDRIVE SYSTEM, RADIO, AND SEATS WERE COMPLETELY UNRESPONSIVE. ALMOST EVERY LIGHT ON THE DASHBOARD WAS ON - LOW TIRE PRESSURE, ABS, AIRBAG LIGHT, PARKING BRAKE MALFUNCTION, CEL, OIL LIGHT, AND OTHERS. UPON FURTHER EXPERIMENTATION, I DISCOVERED THAT THE CAR WOULD OPEN COMPLETELY IF I UNWITTINGLY HELD THE UNLOCK KEY FOR NO MORE THAN 3 SECONDS. 3 SECONDS HAS COST ME THOUSANDS OF DOLLARS IN REPAIRING CONNECTORS, THE IDRIVE SYSTEM, REPLACING CARPETS, AND MORE. ON TOP OF THAT, THE VEHICLE HAS BEEN IN THE SHOP FOR ALMOST A MONTH BECAUSE OF THE TIME IT TAKES TO INVESTIGATE THESE ISSUES AND ORDER REPLACEMENT PARTS.

EXPERIENCED DRIVE TRAIN MALFUNCTION WARNING ALONG WITH SHAKING AND LIMP MODE NUMEROUS TIMES WHICH RESULTED IN 2 REPAIRS LAST YEAR IN THE THOUSANDS ONLY TO FIND OUT IT WAS DUE TO THE CAM SHAFT BOLTS RECALL AT THE ROOT OF THE INITIAL CAUSE OF THE FAILURES THAT RESULTED. BMW WAS HESITANT TO PAY INITIALLY BUT MY HUSBAND IS A LITIGATION ATTORNEY AND ONCE HE GOT INVOLVED, THEY WERE QUICK IN DOING THE RIGHT THING. I AM CURRENTLY HAVING ISSUES WITH THE NO WARNING LIGHT SHOWING TO WARN ME OF A LOW COOLANT LEVEL. IT WAS NOT UNTIL AFTER SMOKE APPEARED FROM THE ENGINE AREA AND A BURNING SMELL THAT THE WARNING FINALLY APPEARED. I IMMEDIATELY STOPPED AND WAITED FOR IT COOL OFF & HAD COOLANT PUT IN, WARNING LIGHT DISAPPEARED. CURRENTLY SMELLING A BURNING SMELL AND HEARING A SQUEAKING NOISE SO HAVE A SERVICE SCHEDULED TOMORROW FOR THE VALVE HEATER RECALL AND HOPE BMW WILL ADDRESS ANY ISSUES STEMMING FROM THAT THAT MAY BE CAUSING OTHER ISSUES. ALSO TO REPORT, RARELY EVER USE THE GLOVE BOX YET THE CORNER OF THE GLOVE BOX HAS COME APART AND WILL NOT REATTACH. I SAW THIS HAS BEEN AN ISSUE REPORTED BY MANY BMW X-3 OWNERS AND I WILL BE EXPECTING BMW TO DO THE RIGHT THING AND PAY TO FIX THIS KNOWN DEFECT.

TAIL LIGHTS WILL FAIL WITH NO WARNING LIGHT OR MESSAGE DISPLAYED IN DASH BOARD. X3'S EQUIPPED WITH HID HEADLAMPS COME WITH FOUR LED TAIL LAMPS. IN EACH LAMP, THERE IS A CIRCUIT BOARD THAT WILL FAIL DUE TO POOR QUALITY CONTROL (THE RESISTORS AND/OR CAPACITORS WILL GET DETACHED FROM CIRCUIT BOARD) , THEREFORE, THE LAMPS WILL STOP WORKING. USUALLY, WHEN LIGHTS BURN OUT, THE DASH WARNS THE DRIVER, BUT NOT FOR THIS FAILURE. THE OWNER COULD BE DRIVING AT NIGHT WITH NO TAIL LAMPS, AND IT COULD LEAD TO A REAR END COLLISION. THE PROBLEM IS NOT THE BULB BURNING OUT DUE TO WEAR AND TEAR. THE ONLY PROBLEM IS THAT LED DRIVER WHICH SHOULD BE REPLACED BY BMW BECAUSE IT IS FAULTY.

I READ THAT THIS ISSUE WAS HAPPENING IN OTHER MODELS, BUT DON'T SEE THAT THE BMW X3 ITSELF WASN'T CALLED OUT. HAD THE ISSUE LOOKED AT BY A MECHANIC AND HE SAID THE STORED CODES WERE FOR MAIN JUNCTION BOX FAILURE OR NO MESSAGE RECEIVED FROM MAIN JUNCTION BOX. IT DOESN'T MATTER IF THE VEHICLE IS STATIONARY OR IN MOTION, ISSUE STILL HAPPENS. SOMETIME WHEN I TURN OFF THE CAR, THE WIPERS ARE STILL GOING. SOMETIMES IF I JUST OPEN THE DOOR, WITHOUT TURNING ON THE CAR, THE WIPERS WILL START TO GO.

ALL LED TAILLIGHTS ON THE BACK OF VEHICLE ARE NOT WORKING. THE CAR DID NOT INDICATE THAT THE LIGHTS WERE OUT LIKE IT DOES FOR OTHER LIGHT FAILURES. AS A RESULT, WE FOUND OUT ABOUT THE TAILLIGHT FAILURE AT NIGHT BY A CAR SPEEDING UP BEHIND US ON THE FREEWAY. THE CAR PROCEEDED TO FLASH THEIR LIGHTS AT US UNTIL WE PULLED OVER TO INSPECT WHAT WAS GOING ON. WE BROUGHT THE CAR INTO A BMW REPAIR SHOP AND THEY INDICATED THAT THERE WAS ANOTHER IDENTICAL VEHICLE (2011 BMW X3) WITH EXACTLY THE SAME ISSUE--ALL 4 LED TAILLIGHTS FAILED. WE THEN WENT TO THE BMW DEALERSHIP TO HAVE THEM INSPECT WHAT THE ISSUE IS AND THEY DON'T KNOW WHAT CAUSED THE TAILLIGHT FAILURE. THEIR REMEDY IS TO REPLACE THE LIGHTS AT SIGNIFICANT COST. GIVEN THAT THEY CAN'T IDENTIFY THE ROOT CAUSE AND ITS A PERVASIVE ISSUE WITH OTHER X3S AFFECTED, I BELIEVE THIS IS A SIGNIFICANT SAFETY ISSUE FOR THIS MODEL OF BMW AND NEEDS TO BE INVESTIGATED IMMEDIATELY. THIS HAS HAPPENED DRIVING ON LOCAL STREETS AND ON A HIGHWAY. WHEN I BROUGHT IT INTO THE REPAIR SHOP, I WAS TOLD THAT THE STEERING MODULE AND STEERING RACK WAS MALFUNCTIONING. THEY SAID THAT BMWNA DID NOT HAVE A RECALL OR FIX ON THIS ISSUE. MY REPAIR SHOP SAID I WOULD NEED TO PAY THE THOUSANDS OF DOLLARS TO HAVE IT REPAIRED. I HAVE READ THAT MANY OTHERS ARE HAVING THIS SAME PROBLEM. I HAVE HAD THIS CODE CLEARED FROM THE REPAIR SHOP A NUMBER OF TIMES NOW.

DUE TO THIS DEFECTIVE COMPONENT I'VE ALREADY SPENT 4000+ IN REPAIRS AND STILL THE CHECK ENGINE LIGHT ON AND I'M DRIVING UNSAFELY AS I DON'T HAVE MONEY TO REPAIR FURTHER. I ALSO HAD TO PUT MY FAMILY ON RISK WITH 2 SMALL KIDS AS THIS SUV WE USE AS A FAMILY CAR. SINCE THE ISSUE IS REPORTED A YEAR AGO AND BMW STILL DIDN'T OFFER ANY FIX INTO PURCHASE A NEW CAR TO SAFEGUARD OURSELVES. THERE ARE 4 LED TAIL LIGHTS ON THIS MOTOR VEHICLE. 3 OF THE 4 HAVE QUIT WORKING. THE FIRST ONE BMW FIXED; THE SECOND ONE I FIXED OUT OF MY POCKET. THE THIRD ONE TO QUIT WORKING IS AWAITING REPAIR. THIS IS A SAFETY ISSUE BECAUSE ALL THE TAIL LIGHTS NEED TO BE WORKING, ESPECIALLY AT NIGHT. IF THE OUTER TAIL LIGHT IS NOT WORKING CONSPICUITY FROM THE SIDE IS SEVERELY REDUCED, ESPECIALLY AT NIGHT. BMW TAKES THE POSITION THAT THIS X3 IS OUT OF WARRANTY AND THEY HAVE NO FURTHER RESPONSIBILITY FOR IT. I TAKE THE POSITION THAT THIS IS A DESIGN DEFECT AND PRODUCT LIABILITY ISSUE FOR WHICH THEY ARE RESPONSIBLE. THE LED DRIVER CIRCUIT BOARD IS DEFECTIVE, BUT BMW IS NOT WILLING TO ACKNOWLEDGE THERE IS A PROBLEM. THERE HAVE BEEN HUNDREDS OF X3 2011-2016 WITH THE F25 BODY THAT HAVE THIS PROBLEM. THE VEHICLE WAS STATIONARY WHEN I NOTICED THE PROBLEM BUT WAS PROBABLY IN MOTION WHEN THE TAIL LIGHT SEGMENT FAILED. FOR LED TAIL LIGHT SEGMENTS TO HAVE A 75% FAILURE RATE SEEMS EXCESSIVE AND UNACCEPTABLE. WOULD BE HAPPY TO DISCUSS THIS WITH YOU.

THE FORCE OF THE IMPACT TORE THE WALL APART FROM THE ROOF - MY CAR WAS STILL ACCELERATING, WHEELS SPINNING. THE BROKE WALL STOPPED BY CAR FROM COMPLETELY GOING OVER AND I WAS ABLE TO TURN THE ENGINE OFF AND GET OUT. THERE WERE WITNESSES WHO CAN VERIFY THAT I WAS AT A COMPLETE STOP, BRAKE LIGHTS ON AND IT ALL HAPPENED IN A FEW SECONDS. IT WAS SO SHOCKING THAT I WILL NEVER DRIVE A BMW AGAIN.

THE CAR WAS EXTREMELY DIFFICULT TO STEER AND HAD TO COME TO A STOP ON A BUSY ROAD. TRIED RESTARTING THE CAR MULTIPLE TIME BUT KEPT GETTING THE ERROR MESSAGE "STEERING RESPONSE AFFECTED! DRIVE MODERATELY. HAVE THE SYSTEM CHECKED BY THE NEAREST BMW CENTER." IT HAD TO BE TOWED ON A FLATBED TO A SHOP AT THIS POINT. AS SOON AS THE SHADE WAS OPENED, SHATTERED GLASS FELL INTO THE CAB OF THE CAR. AN INTERNET SEARCH REVEALED THAT THIS WAS NOT AN ISOLATED CASE. IT WAS DRIVEN TO THE DEALER AND THE REPAIR WAS DONE AT NO COST AFTER SOME INTENSE CONVERSATION WITH MANAGEMENT. THE MOST RECENT ISSUE OF CONSUMER REPORTS HAD EXTENSIVE COVERAGE OF UNEXPLAINED MOON ROOF EXPLOSIONS. DURING THE COVERAGE, IT WAS ADVISED THAT INCIDENTS SHOULD BE REPORTED TO YOU SO FOLLOW UPS COULD BE DONE AS NEEDED. THERE APPEARS TO BE A CHRONIC DEFECT ON BMW X3S (2011-2017 F-25 CHASSIS) OF LET TAIL LIGHT FAILURES DUE TO DEFECTIVE LED CURRENT REGULATOR CIRCUIT BOARDS. OUR X3 HAS HAD 3 OF THE 4 LED TAIL LIGHTS FAIL BECAUSE OF EXACTLY THE SAME DEFECT. SOME OF THE LED CURRENT REGULATOR BOARDS WERE APPARENTLY POORLY SOLDERED AND SOLDER JOINT FAILURE CAUSE COMPLETE OR PARTIAL LOSS OF THE TAIL LIGHTS. THE "ON-BOARD" LIGHT MONITORING SYSTEM ON THE VEHICLE DOES NOT REPORT THE LIGHT FAILURE, SO THE OWNER IS USUALLY NOT AWARE THAT THE VEHICEL HAS NO TAIL LIGHTS VISABLE. ON OUR X3 THE LED TAIL LIGHT FAILURE WAS TRACED TO THE SAME COMPONENT ON ALL (3) LIGHTS. TEH CIRCUIT BOARD (LABELED VALEO B 003809.2) HAD A RESISTOR (R750) THAT WAS NOT SOLDERED PROPERLY. RE-SOLDERING THE COMPONENT FIXED THE PROBLEM AND RESTORED CORRECT LED TAIL LIGHT OPERATION. THERE ARE MANY ON-LINE REPORTS OF BMW X3S HAVING EXACTLY THIS PROBLEM. THIS IS NOT THE WELL-KNOWN 3-SERIES AND 5-SERIES TAIL LIGHT ISSUE RELATED TO CONNECTOR GROUND ISSUES. THE X3 TAIL LIGHT ISSUE IS DUE TO POOR CIRCUIT BOARD MANUFACTURING LEADING TO EARLY FAILURES. IT IS ESPECIALLY OC CONCERN BECAUSE THE OWNER MAY EXPECT TO BE NOTIFIED OF THE LIGHT FAILURE BY THE BMW ON-BOARD MONITOR SYSTEM (WHICH WILL REPORT HEADLIGHT, TURN SIGNAL OR BRAKE LIGHT FAILURES BUT NOT THE LED TAIL LIGHTS LOSS. WHEN THE CIRCUIT BOARD FAILS, THE LED LIGHTS ARE NON-FUNCTIONAL. IT DOESN'T MATTER IF THE VEHICLE IS RUNNING OR PARKED WITH PARKING LIGHTS TURNED ON. THE TAIL LIGHTS ARE STILL DARK. IN MY OPINION, THIS CONSTITUTES A SERIOUS SAFETY ISSUE FOR ALL "F-25" BMW X3S AND SHOULD BE THE BASIS FOR A RECALL. THE (PLUG-IN) CIRCUIT BOARDS CAN BE EASILY REMOVED AND REPLACED WITHOUT REPLACEMENT OF THE ENTIRE (EXPENSIVE) (ABOUT $340 EACH) TAIL LIGHT ASSEMBLY.

WHILE DRIVING ON AN INTERSTATE ROAD, EXITING A TUNNEL, THE X-3 SUDDENLY, WITHOUT ANY WARNING OR INDICATORS, LOST THE POWER STEERING AND POWER BRAKES. THE ENGINE LOST POWER AND THE DASH BOARD LITE UP WITH A MYRIAD OF WARNINGS THAT MADE NO SENSE. THEN, JUST AS SUDDENLY THE ENTIRE DASH BOARD WENT DARK. THE VEHICLE WAS EXTREMELY DIFFICULT TO STEER AND STOP. SINCE I WAS IN FAST MOVING TRAFFIC, THE SITUATION WAS SCARY TO SAY THE LEAST. I FOUND A PLACE TO PULL OFF AND DID SO. I TURNED THE X-3 OFF. AT RESTART IT SEEMED OK, BUT THE PROBLEM RE-OCCURRED AGAIN. I WAS ABLE TO FINALLY GET TO MY HOUSE. STOPPING AND RE-STARTING SEVERAL TIMES. LOSING ALL POWER, BRAKES, STEERING, ETC AT EACH INSTANCE. VEHICLE WAS PLACED ON A FLAT BED AND TAKEN TO SEWICKLEY BMW THE FOLLOWING DAY. AFTER ALMOST A WEEK, THE CAR WAS RETURNED TO ME. I WAS TOLD IT WAS AN ELECTRICAL ISSUE. EXACTLY 2 WEEKS LATER THE SAME PROBLEMS RE-OCCURRED. AGAIN I WAS ON AN INTERSTATE AND THE LOSE OF CONTROL AT A HIGH RATE OF SPEED COULD HAVE BEEN A CATASTROPHE IF AN INEXPERIENCE DRIVER WAS BEHIND THE WHEEL. THE CAR WAS REPAIRED AGAIN AND THIS TIME MORE WORK WAS DONE. THE DEALER SAID THAT THEY FOUND A BULLETIN FROM BMW THAT EXPLAINED THIS POSSIBILITY. I SAW THE BMW INFO AND IT UNDERSTATED WHAT ACTUALLY COULD OR WOULD OCCUR SHOULD THEIR SYSTEMS FAIL. IN MY OPINION, MY LIFE WAS IN SEVERE JEOPARDY WHEN THE FAILURES OCCURRED AND HAD I NOT BEEN AN EXPERIENCED DRIVER WITH CALM REACTIONS, A FATALITY IS NOT OUT OF THE QUESTION. MY WIFE WILL NO LONGER RIDE IN THE VEHICLE AND I HAVE BEEN TOLD TO GET RID OF IT ASAP. I REPORTED THESE INCIDENTS TO BMW AND QUITE FRANKLY THEY WERE TOTALLY INDIFFERENT TO THE PROBLEM, ONLY SAYING THAT THE VEHICLE IS OUT OF WARRANTY AND THEY HAVE NO OBLIGATION TO DO ANYTHING FOR ME. MY VEHICLE SUDDENLY LOST POWER STEERING CONTROL AND A YELLOW WARNING SYMBOL APPEARED ON THE INSTRUMENT PANEL. I EXPERIENCED THE PROBLEM THE FIRST TIME WHILE I MANEUVERED A CORNER. I TOOK THE CAR IMMEDIATELY TO MURRAY MOTORS (IN DENVER, CO) AND WAS ADVISED THAT THERE WAS SIMPLY A COMPUTER PROGRAMMING "GLITCH" THAT CAME FROM THE FACTORY; THE SERVICE CENTER ADVISED THEY DOWNLOADED NEW SOFTWARE AND THE PROBLEM WAS SOLVED. SOME WEEKS LATER, I AGAIN LOST POWER STEERING SUDDENLY WHILE DRIVING STRAIGHT. I TOOK THE CAR INTO MURRAY MOTORS AGAIN AND STRESSED THE ENORMITY OF MY CONCERN OVER THIS FRIGHTENING PROBLEM. AFTER SOME DAYS, MURRAY MOTORS ADVISED ME THAT THE ELECTRONIC POWER STEERING ASSIST UNIT HAD FAILED. THEY REPRESENTED THEY REPLACED THE POWER STEERING RACK, THE ELECTRIC MOTOR MOUNTED ON THE RACK, AND THE EPS MODULE. I RESEARCHED BMW RECALLS THEREAFTER AND FOUND THAT A RECALL HAD BEEN ISSUED FOR THIS PROBLEM ON SEVERAL BMW MODELS ALREADY. I CALLED BMW'S CUSTOMER RELATIONS NUMBER (1-800-525-7417) AND WAS INFORMED THAT MY VEHICLE VIN NUMBER FELL OUTSIDE THE SCOPE OF THE CURRENT RECALL, AND I WAS THEREFORE NEVER NOTIFIED. I AM WRITING THE NHTSA TO REPORT THAT BMW'S RECALL IS NOT BROAD ENOUGH AS DEFECTS IN THE EPS MODULE AND RELATED PARTS EXIST IN VEHICLES BEYOND THE IMMEDIATE RECALL. (BMW REPORTED A SAFETY RECALL TO NHTSA ON JUNE 28, 2011, AS DOCUMENTED IN A LETTER OF JULY 1, 2011 FROM NHTSA TO BMW, ACKNOWLEDGING THE RECALL.) ON SATURDAY NOVEMBER 19, 2011, THE WARNING, "CHASSIS STABILIZATION MALFUNCTION!" APPEARED ON THE VIDEO DISPLAY OF OUR X3 FOLLOWING ENGINE STARTUP. AT THE SAME TIME, STEERING WAS MORE DIFFICULT THAN NORMAL. AN HOUR LATER, DURING ENGINE RE-START, THE WARNING DID NOT RECUR, AND STEERING WAS NORMAL. PERSONNEL AT OUR LOCAL BMW DEALERSHIP WERE NOT ABLE TO EXPLAIN OUR OBSERVATIONS AND TOLD US VIA TELEPHONE TO CONTINUE USING THE VEHICLE. IN SPITE OF THAT, WE ADVISED THE DEALERSHIP THAT WE WOULD BRING THE VEHICLE TO THEM FOR EVALUATION ON MONDAY, NOV 21. WE LEASED THE ABOVE BMW X3DRIVE 35I (SHIPPED ON 3.30.2011) FROM HUSKER AUTO GROUP, BMW OF LINCOLN, NE ON MARCH 30, 2011 FOR A 3-YEAR PERIOD. IN MID APRIL I NOTICED A VERY LOUD NOISE COMING FROM THE ENGINE AFTER I TURNED THE CAR OFF. THE CAR HAD 567 MILES ON THE ODOMETER AND WAS TAKEN BACK TO BMW OF LINCOLN FOR REPAIRS ON APRIL 26, 2011. WE WERE TOLD THE MAIN CRANKCASE SEAL WAS CAUSING HIGH PRESSURES AND WAS THE PROBLEM. APPARENTLY REPLACING THE VALVE COVERS WOULD RESULT IN IT BEING FIXED. WITHIN A WEEK, I NOTED THE EXACT SAME NOISE. THE CAR NOW HAD 1391 MILES ON THE ODOMETER WAS AGAIN RETURNED TO BMW OF LINCOLN ON MAY 12, 2011. THIS TIME I WAS TOLD THE MASTER SEAL WAS BROKEN. BMW OF LINCOLN REMOVED THE TRANSMISSION AND REPLACED THE REAR MAIN CRANKCASE SEAL. ON SEPTEMBER 4, 2011, WE WERE DRIVING AT 25 MILES/HOUR WHEN THE DASH LIT UP WITH A DRIVE TRANSMISSION ALERT. IMMEDIATELY THEREAFTER, WE HEARD AN EXTREMELY LOUD SOUND COMING FROM UNDER THE CAR. IT SOUNDED LIKE THE CAR HAD BROKEN IN HALF AND THE ENTIRE ENGINE HAD FALLEN OUT. THE DASH THEN DISPLAYED A CHASSIS ALERT FOLLOWED BY A TRANSMISSION ALERT. THE CAR ROLLED BACKWARDS DESPITE BEING PUT IN PARK. CAR VEERING TO THE RIGHT, INCREASED ON SUDDEN STOPS; HAPPENS AT VARIOUS SPEEDS. THE PROMINENT AND DANGEROUS CONDITION IS LAG IN ACCELERATION. SENT THE FOLLOWING E-MAIL TO DEALER& BMW ALONG WITH 3 SERVICE REPORTS FROM DEALER ATTEMPTS TO ADDRESS: "THIS X3 3.5I WITH ALL IT IS ELECTRONIC ENGINE/DRIVE TRAIN CONTROLS IS A NIGHTMARE. IT?S A HUGE DESIGN FLAW THAT IS GOING TO KILL SOMEONE EVENTUALLY. YET AGAIN, YESTERDAY, I FELT UNSAFE DUE TO THE HESITATION. THE CAR DIDN'T MOVE FOR ABOUT A SECOND OR TWO WHEN I TRIED TO MAKE A LEFT TURN IN AN INTERSECTION AND THEN AGAIN WHEN I WAS ON THE HIGHWAY CHANGING LANES. THERE WERE CARS HEADING TOWARDS ME BUT THE INITIAL DISTANCE WAS QUITE COMFORTABLE AND SAFE. WITH THE HESITATION OF THE X3, I WAS ACTUALLY IN A PANIC AND STEPPED REALLY HARD ON THE GAS PEDAL TO AVOID A POTENTIAL COLLISION. AND SINCE THEN I HAVE BEEN STEPPING ON THE GAS PEDAL MUCH HARDER, GUZZLING GAS, NOT TO MENTION ROUGH STARTS OFF OF A FULL STOP. I HAVE SEEN COUNTLESS INTERNET THREADS OF PEOPLE COMPLAINING ABOUT THE SAME THING WITH THE X3 MODEL, BOTH VERSIONS, HOWEVER EQUIPPED. I WOULD STRONGLY SUGGEST SOMEONE LOOK AT HOW THIS CAR?S SOFTWARE IS FAILING TO FUNCTION AND FIX THIS THING. I WILL REPORT THE PROBLEM TO THE APPROPRIATE GOVERNMENTAL AGENCIES. THE VEERING IS STILL THERE AND EVENTUALLY I WILL COME TO PASS THE ISSUE WITH THE LOW TREAD LIFE RUN-FLATS BMW'S 2-23-11 VISIT, DEALER ALIGNED VEHICLE, KEPT CAR ONE DAY DUE TO FACTORY SPECS NOT YET BEING LOADED ON NEW VEHICLE MODEL; ON 7-13-11, DEALER NOTED CAR LEFT IN TRANSPORT MODE, REMOVED CODES FROM COMPUTER SOFTWARE AND CAR DROVE OK FOR 4 DAYS; 7-23-11 TOOK IT BACK FOR SAME ISSUE AS NOTED ABOVE WITH LAG IN ACCELERATION BECOMING DANGEROUS AND STILL VEERING, THIS TIME DEALER NOTED NOTHING WRONG WITH CAR AFTER TEST DRIVE COMPARISON. GAVE CAR BACK, STILL HAVE ISSUES WHICH PROMPTED E-MAIL.

THE VEHICLES COMPUTER SYSTEM FLASHED A WARNING SIGNAL WITH A HALF ENGINE ICON STATING: DRIVE MODERATELY. MAXIMUM DRIVE TRAIN OUTPUT NOT AVAILABLE. HAVE THE SYSTEM CHECKED BY YOUR SERVICE CENTER. THE DEALER HAD ISOLATED THE PROBLEM AND STATED A VACUUM TUBE SUPPLYING AIR TO THE ENGINE WAS CRIMPED. HOWEVER, THE NEXT WEEKEND, THE CONSUMER EXPERIENCED A SIMILAR THOUGH LESS EXTREME LOSS OF POWER AND THE SAME DRIVE TRAIN WARNING APPEARED AGAIN. THE VEHICLE WAS TAKEN TO THE DEALER AGAIN, WHERE THEY STATED A POSSIBLE CAUSE WAS A FAULTY GASKET, BUT WAS NOT SURE IF IT WOULD RESOLVE THE PROBLEM. *JB
